Engagement Session 2008 Contest Rules

1. ELIGIBILITY:
This contest is open to residents of Ontario, Canada, except employees and the immediate family of
Shimla Photography, and their respective partners and affiliates and their respective advertising and
promotional agencies, and all persons with whom they are domiciled. Where the contestant is not over
the age of majority and they are a chosen winner, the contestant must have any or agreements signed
by their legal guardian in order to be declared the winner.

2. HOW TO ENTER:
Contest entries must be received on or before 11:59 p.m. EST January 31, 2008 (“Contest Closing
Date”). To be entered into the contest:

(a) Complete and submit your wedding information via
www.shimlaphotography.com/contact_us.html

(b) Sign and submit your wedding contract and deposit to Brian Shimla Photography.

3. PRIZES:
One grand prize winner will have their engagement photographs taken and featured in “Shimla
Photography website” and possibly other media. Photographs will be given to the winner in the form of
digital negatives. The winner will agree to have his/her photo(s) edited or revised as appropriate for
selected media.

Session Description

One location, 1.25 hours: Approximate value $225. All high resolution ready to print images on
disc. Password protected online viewing for 90 days. Two 8 x 10 portraits.

All of your images can be viewed on our individually password protected website. Approximately
60 photographs will be taken for you to choose from.

4. WINNER DETERMINATION:
The winner will be determined shortly after 12:00 p.m. EST, on or before February 14, 2008 from
among all eligible entries received on or before the Contest Closing Date. The determination will be
made by Brian Shimla based on a random draw. Chances of selection are dependent on the total
number of eligible entries received by the Contest Closing Date.

5. CONDITIONS OF PARTICIPATION:
By participating in this contest participants agree:

(a) All entries become the property of Brian Shimla and none will be returned. By submitting an entry,
Entrants agree to all contest rules and all wedding contract rights. The selected Entrant will be notified
by email or telephone not later than February 29, 2008, and informed of all necessary arrangements. In
the event that the selected Entrant cannot be contacted within fourteen (14) days of the contest draw
another entrant will be selected by Brian Shimla. Contest winner must consent to the use of their
names, photograph(s), voice, video footage and/or statements for publicity purposes without
compensation, in any future publicity carried out by Brian Shimla (Photography) in connection with this
or any similar contest.

(b) All decisions by Brian Shimla are final.

(c) NFS cheque payments void entries.

(d) The prize becomes void if not completed prior to the contract wedding date.

(e) The prize is nontransferable and has no cash surrender value.

(f) The winner agrees, prior to the photo session, to complete a standard declaration and release form,
confirming eligibility and compliance with the contest rules and releasing Brian Shimla and his
respective partners and affiliates and his respective advertising and promotional agencies from all
liability caused by, resulting from, or arising out of his/her participation in the Contest and the
publication of his/her photos or, the use of any personal information.

(g) Brian Shimla and his respective partners and affiliates and his respective advertising and
promotional agencies, each assume no responsibility for lost, stolen, delayed, damaged, or
misdirected entries, or for any failure of the website during this contest, for any problems or technical
malfunction of any telephone network or lines, computer online systems, services, access providers,
computer equipment, software, failure of any e-mail or entry to be received by “Brian Shimla
Photography” on account of technical problems or traffic congestion on the internet or the website or
any combination thereof including any injury or damage to an entrant's, or any other person’s computer,
related to or resulting from playing or downloading any material in the promotion. Any attempt to
deliberately damage the website or to undermine the legitimate operation of this promotion is a violation
of the Criminal and Civil laws, and should such an attempt be made, Brian Shimla reserves the right to
seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Entries are subject to verification and will be declared invalid if they are illegible, mechanically
reproduced, mutilated, forged, falsified, altered or tampered with in any way.

(h) This contest is subject to all applicable federal, provincial and municipal laws and regulations and is
void where prohibited.

(i) Entrants agree that the personal information collected for purposes of this contest can be collected,
used and disclosed by Brian Shimla.

(j) Brian Shimla reserves the right, in his sole discretion, to change the terms of this contest or to
cancel or suspend this contest at any time for any reason whatsoever, without prior (or any) notice.
